Scale first, because it sets the economics. TikTok's DSA Article 24(2) disclosure for 1 January to 30 June 2026 (report published 31 August 2026) puts Belgium at roughly 4.6 million average monthly active recipients, about 39% of the 11.8 million population but only about 2.4% of TikTok's 189 million EU total. Belgium is a penetration story, not a volume story. For context, BeCommerce reported EUR 17.4 billion of Belgian consumer online spend in 2024, up 6.7% year on year. The fixed cost of running Belgium properly, dual Dutch and French localisation plus three separate EPR schemes, is amortised over a small base, which is exactly why so many brands defer it.
The difficulty in Belgium is structural rather than commercial. TikTok charges the same commission here as in Germany. What differs is that there is no platform fulfilment on the domestic lane, no platform-side Dutch or French tooling, a country-specific product ban, three regional environmental authorities instead of one national body, and a two-year reversed burden of proof on defects. Seller eligibility: what TikTok requires before it will approve a Belgian shop
TikTok Shop's default rule for Belgium is a local entity, not merely an EU entity: a Legal Entity applicant must be legally incorporated in the country of registration, must store inventory in that country, must ship all Local-to-Local items domestically and must accept returns domestically, with an address or lease produced as evidence on request. The only published escape is discretionary: larger enterprises that can demonstrate advanced logistics capabilities may be allowed to ship from a warehouse in any EU locale, at TikTok Shop's sole discretion and case by case.
TikTok recognises two applicant types, Legal Entity and Sole Trader. The business representative must normally hold an EU-issued passport or national identity card and be a local resident with a domestic address plus proof of address. Registration collects the trade register number, VAT number, warehouse address, IBAN and BIC, tax identification number and a customer-facing complaints address and phone. Where requested, Legal Entity applicants must disclose directors and anyone holding 25% or more of the shares or control. Representatives and persons with significant control may be required to pass a liveness check. Onboarding is approval-gated: applicants cannot list products before TikTok verifies the information.
Two Belgian specifics change the pack you assemble. First, the bank account must be a business account at an EU institution registered in the entity's name, with an unredacted first page of a statement uploaded. Second, since 29 March 2025 Belgian law obliges online marketplace operators to verify whether sellers are Recupel members or hold an individual waste management plan, and to refuse platform access where they are not. Have the Recupel membership number ready at TikTok Shop onboarding for any electrical SKU sold into Belgium. Shop names are capped at 40 characters, cannot contain "TikTok", "Tik" or "Tok", and can only be changed once every 30 calendar days and never in the first 30 days after registration. Fulfilment: Belgium has no platform logistics on the domestic lane
This is the single biggest Belgian delta and the one most import plans get wrong. TikTok's EU Customer Order Shipping Policy table reads for Belgium, verbatim in the French edition: "Belgique | Expédié par le vendeur | Expédié par le vendeur | Expédié par le vendeur est le seul type d'expédition disponible." Ship by Seller is the only shipping type available for Local-to-Local TikTok Shop orders in Belgium. Ship by TikTok and Fulfilled by TikTok, both available in Spain, Germany, Italy and France (where Ship by TikTok is the default) and Ship by TikTok in Poland, are simply not offered for domestic Belgian orders.
The mirror image is counter-intuitive and worth stating on its own. For Sell Across EU orders originating from Belgium, Ship by TikTok and Fulfilled by TikTok ARE available and Ship by TikTok is the default, putting Belgium in the same row as Germany, France, Italy, Spain, Poland and the Netherlands. A Belgian TikTok Shop therefore gets platform logistics on its cross-border orders but not on its domestic ones. Practically, the Belgian domestic lane needs its own carrier contract, label cost model and delivery-SLA cover even for a seller already using Ship by TikTok cross-border. TikTok does not embed a Belgian carrier table in the shipping policy, so pull the approved logistics provider list from Seller Center after onboarding rather than trusting third-party blogs.
Returns and the Belgian warranty tail
Belgium runs the maximum-length conformity presumption in the EU. The Act of 20 March 2022, in force 1 June 2022, provides that any lack of conformity appearing within TWO YEARS of delivery is presumed to have existed at delivery unless the seller proves otherwise, against the EU minimum of one year and against the old Belgian six-month rule. For two full years the burden of disproving a defect sits on the seller, which materially raises the expected cost of the warranty tail on Belgian TikTok Shop orders. Because Local-to-Local sellers must accept returns domestically, that tail lands on a Belgian address you control.
On escalation, Belgium's national ADR body is the Consumer Mediation Service (Consumentenombudsdienst / Service de médiation pour le consommateur), with the FPS Economy's Belmed platform for online dispute handling. The Service only intervenes in disputes with companies established in Belgium, which cuts both ways: it narrows formal Belgian ADR exposure for a non-established seller, but it removes the escalation channel Belgian consumers expect and pushes disputes toward ECC Belgium and card chargebacks. Where a business does not follow a Consumer Mediation Service recommendation it has 30 calendar days to give a reasoned opinion. Note also that a Belgian checkout expectation is Bancontact, the domestic scheme reporting over 2.5 billion transactions annually; TikTok publishes nothing about which methods it exposes at Belgian checkout, so treat conversion here as real and unquantified risk.
Listing language: Belgium is the only bilingual obligation in the EU8
Belgium is the only TikTok Shop EU market with a statutory per-region language rule rather than one national language. The FPS Economy requires the label and instructions to be in Dutch for the Dutch-language region, French for the French-language region and BOTH languages for the Brussels-Capital Region, with German added for products placed on the market in the German-language Community. A TikTok Shop listing is served nationally and cannot be geo-split by linguistic region, so dual NL and FR listing content plus dual-language customer service is the only safe posture.
TikTok does not help here. The Belgian seller site publishes exactly one Belgian locale alternate, hreflang="en-BE", with no nl-BE and no fr-BE alternate. Budget the localisation of titles, attributes, A+ content, customer service macros and returns correspondence into two languages as a fixed Belgian cost, on a market that is roughly 2.4% of TikTok's EU audience.
Creator and affiliate mechanics: stricter disclosure than the platform requires
Belgium enforces a stricter-than-platform disclosure vocabulary. Per the FPS Economy position summarised by hub.brussels, terms like "collaboration", "sponsored" and "ambassador" are considered too ambiguous; the post must be immediately recognisable as advertising, using words such as "advertentie" or "publicité" placed prominently at the START of the post rather than buried in hashtags. The legal hook is Book VI, Title 4, Chapter 1 of the Code of Economic Law, with Article VI.99 §2 treating failure to identify commercial intent as a misleading omission. Because the disclosure has to be understood by the audience, the same bilingual split applies: Dutch tags for Flemish audiences, French for Walloon.
Enforcement is two-bodied in a way no other EU8 market replicates. The Economic Inspectorate of the FPS Economy runs checks and can fine, while the JEP (Jury voor Ethische Praktijken inzake reclame / Jury d'Éthique Publicitaire) handles complaints with non-binding but widely followed decisions. Both the advertiser and the influencer can be liable. Belgian creators earning regularly must register with the Crossroads Bank for Enterprises and display their enterprise number, address and email on their social profiles, so affiliate onboarding in Belgium should collect a KBO/BCE number, not just a payout account.
The Belgian compliance stack, with named schemes
Packaging splits across two PROs. Fost Plus VZW/ASBL is the recognised scheme for HOUSEHOLD packaging and runs the Green Dot licence through the MyFost portal, with contribution based on quantity and type of packaging placed on the market and a minimum of EUR 100 (EUR 50 by direct debit). Valipac is the counterpart for COMMERCIAL AND INDUSTRIAL packaging, and a seller placing both on the Belgian market must join both, a split with no equivalent in most EU markets. Companies placing at least 300 tonnes of single-use packaging on the market annually must file a three-year prevention plan (100 tonnes for companies packing in Belgium). The national producer register is operated by EPRiBEL, formerly IVC-CIE, the joint commission of the Flemish, Brussels-Capital and Walloon Regions. Fost Plus performs register registration collectively for its members at no additional cost, and any annual registration fee applies only from calendar year 2027. The clause that catches every foreign seller: under the PPWR, from 12 August 2026 a foreign producer must be represented by an Authorised Representative for EPR who is established in Belgium and registered with EPRiBEL.
Electricals run through Recupel VZW/ASBL. Online distance sellers shipping to Belgian consumers must become a Recupel member or submit an individual waste management plan, and foreign sellers must appoint an authorised representative in Belgium, a role Recupel offers to fill free of charge for members. Reporting is regionally fragmented with no single national WEEE authority: OVAM for Flanders, Brussels Environment for Brussels-Capital and the Sol et Déchets administration of the Service public de Wallonie for Wallonia, with declarations filed via the BeWeee platform and member reports submitted annually in January. Belgium is also a visible-fee country, a rule that touches the listing and not just the back office: the Recupel contribution must appear on the receipt or invoice, with "Recupel contribution included" as the B2C minimum and a separate per-appliance line on B2B invoices. That regime has applied to household appliances since 1 July 2008, and a price and invoice template built for Germany or the Netherlands will not satisfy it.
Batteries run through Bebat VZW/ASBL, operating under EU Battery Regulation 2023/1542 plus federal and regional Belgian law and building the Belgian battery register. Bebat's producer definition expressly captures any party based outside Belgium making batteries available to Belgian end users through distance selling, including online sales, and it covers loose batteries as well as batteries built into devices and vehicles. Three further Belgian items belong on the checklist. On VAT, the 12% intermediate band is a genuine structural difference from two-rate neighbours such as the Netherlands (21% and 9%), so a two-rate EU mapping will mis-rate Belgian SKUs; and because TikTok's default rule sends Local-to-Local goods from a Belgian warehouse to a Belgian consumer, those are DOMESTIC supplies outside OSS requiring a Belgian VAT registration and Belgian returns. On invoicing, mandatory domestic B2B structured e-invoicing over Peppol in BIS Billing 3.0 / EN 16931 format has applied since 1 January 2026, with penalties reported at EUR 1,500, then 3,000, then 5,000 from 1 April 2026, but foreign entities solely VAT-registered in Belgium without a permanent establishment are excluded as issuers and recipients, and there is no B2C mandate, so consumer orders are unaffected.
