Italy is one of the four most operationally mature TikTok Shop markets in the EU. TikTok Shop opened to Italian consumers and third-party sellers on 31 March 2025, the same day as Germany and France and nine months after the December 2024 Spain and Ireland launches. TikTok's Italian newsroom post of 27 March 2025 put the addressable base at 22.8 million users in Italy.

Scale has moved since. TikTok's Italian one-year review, published 27 April 2026, reports 25.2 million monthly active users in Italy, over 21,000 active Italian sellers, and triple-digit percentage growth in daily revenue across six months. Shoppable video drives 38% of Italian TikTok Shop revenue and LIVE shopping 20%, led by beauty, fashion and home. Nearly 1 in 5 Italian e-shoppers now buys through TikTok Shop, over-40s generate 41% of value (against 32% across Italian e-commerce), and heavy shoppers place roughly 32 orders a year against an Italian average of 22.5.

What makes Italy hard is not demand, it is the compliance stack. Italy is one of only three EU markets with a TikTok Shop EPR Pay on Behalf fallback, yet two of Italy's three producer responsibility regimes are yours alone to solve. Seller eligibility: what TikTok Shop requires to approve an Italian account

The Italy-specific gate is tax registration. In TikTok Shop's EU onboarding guide the VAT field is required only in Germany and Italy for a sole trader (ditta individuale), and optional except for Italy for a company: partita IVA is mandatory for an Italian legal entity. A personal codice fiscale is required for unregistered individual sellers in Germany and Italy only, and TikTok Shop checks the business against the Registro Imprese. Italian VAT registration then adds a disclosure with no EU equivalent: e-commerce operators must declare the website address and the identifying data of the internet service provider, with changes notified within 30 days.

Italy sits inside TikTok Shop's five-market Seller Center (Germany, France, Italy, Spain, Ireland), and other EU shops stay locked until the Italian home shop is approved. The EU baseline then applies unchanged: local incorporation, stock held in-country, an EU business bank account, beneficial ownership evidence at 25% or more, and no listing rights before verification.

The marketplace deemed-supplier rule reaches only sellers not established in the EU, plus imported consignments not exceeding EUR 150 in intrinsic value. Holding Italian stock through an EU entity, you are liable for Italian output VAT at 22%. Note the legal basis: DPR 633/1972 art. 16 now shows on Normattiva as repealed by the Testo Unico IVA (D.Lgs. 19 gennaio 2026, n. 10), applying from 1 January 2027.

Fulfilment in Italy

Italy sits in TikTok Shop's Gestito da TikTok shipping tier. Under the EU Customer Order Shipping Policy (Italian version, revision 27 August 2026), Local-to-Local orders in Italy, Spain, Germany and France may use Ship by TikTok or Ship by Seller, Ship by TikTok is the default, and switching needs no approval. Ireland, the Netherlands and Belgium have Ship by Seller as their only option. For Sell-Across-EU orders from Italy, Ship by Seller requires whitelisting.

Two things are unpublished: TikTok Shop's approved carrier list is tagged to the United Kingdom only, and Fulfilled by TikTok appears only in the UK tree. Treat Italian fulfilment as seller-owned or 3PL.

Returns and the Italian guarantee tail

Italy gets no country-specific annex to TikTok Shop's EU Seller Terms of Sale, unlike Germany and France (Annex A). Italian buyers run the plain EU policy: a 14-day statutory right of withdrawal plus a seller-funded 30-day extended return window, with refunds processed within 14 days.

The Italian delta is statutory. Art. 133 of the Codice del Consumo, replaced by D.Lgs. 170/2021 for contracts from 1 January 2022, holds the seller liable for lack of conformity appearing within two years, but the action prescribes in any case within 26 months from delivery. That 26-month longstop has no EU-baseline equivalent and is the number an Italian TikTok Shop warranty policy should be written against. For second-hand goods both periods may be cut, never below one year.

Listing language: Italian is a legal requirement

Selling on TikTok Shop in Italy in English is a breach, not a soft failure. Art. 9 of the Codice del Consumo requires all consumer information to be given at least in Italian, and where several languages appear the Italian must be no less visible or legible than the others. In force since 23 October 2005.

Food is stricter. TikTok Shop's Italian food and beverage guide (revision 19 May 2026) requires the label to carry the name or address of the food business operator in Italy, plus net quantity, durability wording, allergens, origin and QUID. TikTok's Food Information to Consumers guidance covers four markets only: Germany, France, Ireland and Italy.

Category gates specific to Italy

Section 4.10 of TikTok Shop's EU Restricted Products Policy heads e-bikes and e-scooters as Ireland, Italy and Germany only, and invite-only: approved Italian sellers need an EU returns address and 3PL-only shipping. Food, beverages and supplements are invite-only across Germany, France and Italy. Graded trading cards recognise GRAAD (Italia) alongside PSA, BGS and CGC, capped at EUR 1,000 per second-hand listing. EU-wide bans, including alcohol above 0.5% ABV, medicines, CBD and vapes, apply in Italy unchanged.

Creators and affiliates: Italy has a statutory influencer register

Italy is the only TikTok Shop market in Europe with dedicated influencer regulation, and sellers running Italian affiliate campaigns are exposed through their creators. AGCOM delibera 7/24/CONS, amended by delibera 197/25/CONS published 5 August 2025, sets guidelines and a binding code of conduct under TUSMA. A relevant influencer reaches at least 500,000 followers or 1,000,000 average monthly views on at least one platform. The first registration deadline was 5 February 2026 and the register refreshes on 15 April and 15 October.

Disclosure must be immediate: Pubblicita, ADV or Sponsorizzato da before the "more" cut and overlaid in a video's opening scenes. There is no de minimis compensation threshold, so gifted product is in scope.

The Italy compliance stack, with named schemes

Packaging EPR: CONAI. Registration and number verification both run through CONAI (Consorzio Nazionale Imballaggi), funded by the Contributo Ambientale CONAI under D.Lgs. 152/2006, with consortia Corepla (plastic), Comieco (paper and board), Cial (aluminium), Ricrea (steel), CoReVe (glass) and Biorepack (bioplastic), plus Interzero Italia. The trap: Pay on Behalf covers packaging in France (0.49%) and Spain (0.89%) but not in Italy, so there is no platform fallback. Hold a valid CONAI number or delist packaged goods. TikTok also requires the number on the consumer invoice.

Battery EPR: Registro pile e accumulatori. Registration runs via Ecolight or Landbell Italia, verified against the national battery register inside RENAP under the Ministero dell'Ambiente e della Sicurezza Energetica, with CDC RPA in Milan as coordination centre and Erion Energy, Cobat Ripara, Consorzio ERP Italia, Ecoped and EcoRecco among the named schemes. Submit no valid Italian battery number and TikTok Shop auto-enrols your shop into Pay on Behalf at 1.65%. The regime changed on 7 March 2026, when D.Lgs. 10 febbraio 2026 n. 29 implemented EU Regulation 2023/1542.

WEEE: the RAEE register TikTok never asks about. The Registro nazionale dei produttori di AEE at registroaee.it sits inside RENAP, run with Unioncamere through the competent Chamber of Commerce under D.Lgs. 49/2014 and DM 185/2007. Registration is mandatory before placing electrical equipment on the Italian market, expressly including distance selling. An annual communication is due and tariffs are billed annually (2024 tariffs published 28 April 2026, payable by 30 June 2026). TikTok Shop's Italy EPR page lists only packaging and batteries.

Establishment and enforcement. TikTok states that a business without an Italian establishment must appoint a rappresentante autorizzato, and that validation takes five or more working days. Enforcement concentrates in AGCM: under art. 27 of the Codice del Consumo, fines run from EUR 5,000 to EUR 10,000,000, with a floor of EUR 50,000 for art. 21(3) and (4) practices, up to 4% of Italian or EU turnover for widespread infringements (or EUR 2,000,000 where turnover data is unavailable), and AGCM may order internet providers to remove listings aimed at Italian consumers, with a further EUR 5,000,000 for ignoring that order.
