Key takeaways

  • TikTok Shop Poland opened to third-party sellers on 15 June 2026, making the Polish marketplace roughly 11 weeks old as of 2 September 2026.
  • Commission on TikTok Shop Poland is 9% of GMV, or 7% on named electronics and beauty-device sub-categories, but verified first-time EU sellers registering in Poland pay 2% for 90 calendar days, against 4% for only 60 days in France, Germany, Spain, Italy and Ireland.
  • TikTok publishes a hard Polish promise: domestic orders fulfilled within a maximum of 4 business days via InPost, DPD or GLS, with BLIK the preferred local payment partner.
  • TikTok gives Polish buyers a minimum 30-day return window from the purchase date, roughly double the 14 days Polish statute requires.
  • Poland is the heaviest compliance market in the TikTok Shop EU footprint: a BDO number before trading, a mandatory Polish WEEE representative, a PLN 0.20 carrier-bag levy, eight deposit operators and Polish-language listings enforced by criminal fine.
  • Incorporating locally to satisfy TikTok Shop's local-entity rule pulls the entity into mandatory KSeF e-invoicing from 1 April 2026, which a foreign-established seller escapes.

TikTok Shop Poland launched on 15 June 2026, confirmed by TikTok's own Polish newsroom post stating the service "oficjalnie wystartował w Polsce". Poland arrived alongside Austria, Belgium and the Netherlands, joining France, Germany, Ireland, Italy and Spain. TikTok framed the launch ecosystem as "ponad 100 tys. sprzedawców oraz blisko 100 mln użytkowników", EU-wide figures with no Poland-only count published.

TikTok anchored the Polish launch on fashion, beauty and lifestyle, naming six day-one sellers including the Polish cosmetics brands beBIO and Eveline and the fashion operator Modivo, so the Polish assortment sits in the 9% commission band, not the 7% electronics band. TikTok also paired the Polish launch with the debut of "Sell Across Europe", one registration letting a Polish seller reach other TikTok Shop EU markets and use cross-market affiliate creators.

TikTok Shop Poland faces the EU's most entrenched incumbent: Allegro's FY2025 results report group GMV nearing PLN 70bn with Polish GMV up 9.4%, and 21 million active buyers of which 15.3 million in Poland, spending on average 7.3% more year on year across more than 80 million products. Allegro Smart! closed 2025 with 7.5 million Polish users, Allegro Pay financed over 15% of GMV, and Allegro Delivery reaches over 36,000 parcel lockers. TikTok Shop Poland therefore competes on discovery, not price. For the pan-EU picture, see the EU-wide TikTok Shop guide.

Seller eligibility: what TikTok Shop Poland requires before approval

The Polish gate is local by default: a Legal Entity applicant must be incorporated in the country of registration, meaning a Polish company for a Polish shop, storing inventory in Poland and accepting returns domestically. The only published escape is discretionary: larger enterprises demonstrating advanced logistics capability may ship from any EU locale, case by case.

Expect to file the KRS or CEIDG register number, a Polish VAT number, an EU business bank account in the entity's own name, the warehouse address and a Polish complaints address. The representative normally needs an EU-issued ID and a Polish residential address, and you may have to disclose anyone holding 25% or more of the shares. Nothing lists until TikTok verifies the file, shop names are capped at 40 characters, and stale data triggers a 7 calendar day correction notice.

Fulfilment: TikTok Shop Poland runs on lockers and a 4-day clock

TikTok publishes a Polish delivery commitment: "Czas realizacji zamówienia na terenie kraju to maksymalnie 4 dni robocze", a maximum of 4 business days for domestic orders, via InPost, DPD or GLS. Naming InPost first matters, because it makes the Polish default parcel-locker pickup rather than courier-to-door, the reverse of the German, French and Italian defaults: parcels must fit a locker slot and returns become drop-offs. TikTok publishes nothing about a Polish warehouse of its own, so plan on seller-fulfilled shipping.

TikTok names BLIK "preferowanym lokalnym partnerem płatniczym TikTok Shop w Polsce", alongside cards, Apple Pay and Google Pay. BLIK is a Poland-only scheme with no counterpart in any other TikTok Shop EU market. Note what is absent from TikTok's published Polish list: cash on delivery.

Returns: a 30-day platform promise on a 14-day statute

TikTok commits in Poland to "min. 30 dni od daty zakupu", a minimum of 30 days from the purchase date, while art. 27 of the ustawa o prawach konsumenta (Dz.U. 2024 poz. 1796) gives a distance consumer only 14 days to withdraw and art. 34 a further 14 days to send the goods back. TikTok's Polish promise is roughly double the statutory minimum and runs from the purchase date rather than delivery, so the legal seller in Poland is bound to 30 days while the statutory clock governs the contract.

Listing language: Polish is statutory, with a criminal sanction

Poland has a listing-language law most EU markets lack. Art. 7 of the ustawa o języku polskim (Dz.U. 2026 poz. 81) requires Polish in consumer dealings where the consumer resides in Poland, and art. 7a extends this to the naming of goods, offers, warranty terms, invoices, receipts, consumer warnings, manuals and product-property information. Art. 7b assigns supervision to the President of UOKiK, the Inspekcja Handlowa and IJHARS, and art. 15 makes exclusive foreign-language use an offence punishable by a fine. Machine-translating a German listing is not compliance if the manual, warranty and warnings in the box stay in another language.

Creators and affiliates: 1,500 followers, then UOKiK

TikTok publishes a Polish affiliate floor: a verified creator needs an active account and "liczba obserwujących na poziomie minimum 1,5 tys.", a minimum of 1,500 followers, to join the TikTok Shop affiliate programme in Poland. TikTok names four in-app buying surfaces: the For You feed, LIVE shopping, the brand profile product showcase and ShopTab.

Poland then layers on a regulator. UOKiK requires "czytelne, jednoznaczne oraz zrozumiałe oznaczanie reklamy" and two-level marking: the platform's commercial-content tool plus separate labelling by the creator in the post description. UOKiK treats barter and gifted product as advertising, a material benefit even with no cash, and treats affiliate links as advertising because the creator "uzyskuje korzyść materialną ze sprzedaży". The duty falls on influencers, agencies and advertisers alike.

The Poland compliance stack, by name

Packaging, WEEE, batteries and the bag levy all run through the BDO, the Rejestr podmiotów wprowadzających produkty, produkty w opakowaniach i gospodarujących odpadami, launched 24 January 2018. Entries are made by the 16 marszałkowie województw, not a national agency, and a numer rejestrowy must be held before trading; with no Polish seat, the Marszałek Województwa Mazowieckiego is the competent authority. See also the compliance glossary.

Packaging and deposit return

Under the packaging act (Dz.U. 2026 poz. 619), art. 17 obliges a wprowadzający produkty w opakowaniach to secure recycling of the packaging it placed on the market, alone or via a licensed organizacja odzysku opakowań such as Rekopol, with the opłata produktowa as the sanction. Art. 6 ust. 3 relieves anyone placing 1 Mg (one tonne) or less of packaging per year, conditional on de minimis filings through BDO by 15 March, and art. 14a requires at least 25% recycled plastic in single-use PET bottles up to 3 litres from 2025, rising to 30% from 2030. Poland also runs a multi-operator deposit system launched no earlier than 1 October 2025, with eight licensed operators from ZWROTKA S.A. (2024) to Polski Operator Kaucyjny S.A. (April 2026).

WEEE and batteries

Polish WEEE law imposes a mandatory local representative on distance sellers. Under art. 26 ust. 2 of the ustawa o zużytym sprzęcie elektrycznym i elektronicznym (Dz.U. 2024 poz. 573), a producer established in another Member State supplying Poland "za pomocą środków porozumiewania się na odległość" must appoint an autoryzowany przedstawiciel established in Poland by written contract on pain of nullity, so selling electronics into Poland from a German or Dutch warehouse without one is a breach, not a grey area. Poland adds a zabezpieczenie finansowe for household equipment, due 30 June, against a 65% collection target. Batteries are a third, separate registration (Dz.U. 2025 poz. 809) with no authorised-representative route.

VAT, KSeF and closed categories

Mandatory structured e-invoicing is the sting in the tail. Per the Ministry of Finance, receiving invoices via KSeF became mandatory for everyone from 1 February 2026; issuing became mandatory from 1 February 2026 where 2024 sales exceeded PLN 200m and from 1 April 2026 for all others, except those invoicing under PLN 10,000 gross per month, relieved until end-2026. The exclusion matters most: the issuing obligation does not reach taxpayers with no seat and no fixed establishment in Poland, so the local-entity decision and the KSeF decision are one decision. Treat alcohol as closed: art. 18 of the ustawa o wychowaniu w trzeźwości (Dz.U. 2023 poz. 2151) ties the licence to the physical point of sale in three strength bands, and art. 96 confines off-premise retail above 4.5% (excluding beer) to enumerated physical outlets.

Where Operator One fits

TikTok Shop Poland concentrates the burdens a brand least wants to own: 16 regional marshals, a mandatory local WEEE representative, eight deposit operators, a criminally sanctioned language rule, a 4-business-day clock and a 30-day return promise on a 14-day statute. Operator One takes the legal seller seat as Merchant of Record and Importer of Record, holding the Polish registrations, VAT and consumer-facing liability so the brand ships product and briefs creators.
