TikTok Shop Spain in September 2026
Spain was one of TikTok Shop's first two European markets, alongside Ireland, and the launch happened in two steps that are widely misreported. TikTok's Spanish newsroom post of 10 December 2024 is headlined "TikTok presenta TikTok Shop en exclusiva para empresas con sede en España" and states that interested businesses established in Spain "pueden acceder al Centro de Vendedores de TikTok Shop, para registrarse a partir de febrero 2025". December 2024 was therefore the consumer-side opening plus an invited cohort, and genuinely open self-serve registration for Spanish-established businesses started roughly three months later, in February 2025. The same post put TikTok's Spanish monthly audience at 20 million people.
By TikTok's own published numbers, Spain is now its most mature continental EU storefront. The May 2026 Spanish newsroom post reports 21,000 sellers operating on TikTok Shop Spain, a NielsenIQ ranking of number 16 among all online retailers analysed in Spain, 18.7% penetration among Spanish online sellers, seventh place among online beauty retailers, and LIVE Shopping sessions up 173% in six months. At the first anniversary in October 2025 TikTok reported more than 12,000 Spanish shops, 23.4 million users, more than 15,000 LIVE Shopping sessions per month (around 500 a day), and more than 20,000 bottles of olive oil sold.
Operationally, Spain sits in TikTok Shop's top tier. It carries the applicability tag on every current EU seller policy (Registration 26 August 2026, Shipping 27 August 2026, Returns 27 August 2026, Prohibited Products 6 August 2026, all scoped to Belgium, Germany, Spain, France, Ireland, Italy, Netherlands and Poland), it is one of four EU markets with Fulfilled by TikTok, and one of three with EPR Pay-on-Behalf. Seller eligibility and what TikTok Shop Spain requires to approve an account
The default rule across TikTok Shop EU is a local entity, not merely an EU one: a Legal Entity applicant must be legally incorporated in the country of registration, hold inventory there, ship Local-to-Local orders domestically and accept returns domestically. For Spain that means a Spanish-incorporated company (or a Spanish sole trader) with a Spanish warehouse address and proof of address, not a French or German entity selling in.
The escape route is discretionary and narrow. TikTok Shop states that "larger enterprises, as determined by TikTok Shop, that are able to demonstrate advanced logistics capabilities, may be eligible to ship from a warehouse located in any EU Locale", decided case by case at TikTok's sole discretion. Cross-locale returns need a second, separate approval.
Registration for TikTok Shop Spain requires the trade register name and number, company registration date, business address and proof, a Spanish VAT number, business representative details with an EU-issued ID and a domestic residential address and proof, an EU business bank account in the entity's own name with an unredacted first full page of a statement, tax information (TIN, financial account identifier, permanent establishment declaration), warehouse address and proof, and customer-facing email, complaints address and phone. Where requested, applicants must disclose directors and anyone holding 25% or more of the shares or control, and representatives may have to pass a liveness check. Onboarding is approval-gated: applicants cannot list products before TikTok Shop verifies the information. Shop names are capped at 40 characters, cannot be changed in the first 30 days, and thereafter only once every 30 calendar days.
Two Spain-specific gates sit on top. First, TikTok Shop's "Managing EPR Requirements in Seller Center" article, dated 17 July 2026, is scoped to only five markets (Germany, Spain, France, Ireland and Italy), with EPR numbers submitted at My Account, Qualification Center, Extended Producer Responsibility, validation taking "5 working days or longer", and a hard rule that the registered EPR legal entity name must match the TikTok Shop account entity or validation fails. Second, since Verifactu deadlines have passed, a Spanish seller issuing its own invoices must already run compliant software.

Fulfilment and carriers in Spain
Spain sits in TikTok Shop's highest logistics tier. The EU Customer Order Shipping Policy dated 27 August 2026 lists Spain with Germany, Italy and France as having three Local-to-Local shipping types: Gestionado por TikTok (Fulfilled by TikTok), Envío por TikTok (Ship by TikTok) and Envío por el vendedor, with Ship by TikTok as the default and no approval needed to switch to seller-shipped. Poland gets only two, and Ireland, the Netherlands and Belgium get seller-shipped only. Spain is therefore one of just four EU markets where TikTok Shop will actually hold and fulfil your stock.
If you ship yourself, TikTok Shop Spain runs a closed carrier list of 21 approved domestic providers as of 29 July 2026: CTT Express, Correos, Correos Express, GLS Spain, SEUR, Amazon Shipping ES, Amazon Logistics, MRW, NACEX, Zeleris, TIPSA, Ontime, Envialia, Sending, Urvaam, Redur, TDN, Ecoscooting, Spring GDS, Method and DACHSER. The Sell Across EU list from Spain is narrower at 15 carriers. TikTok validates tracking numbers against per-carrier Spanish formats at upload (Correos Express 16 or 23 numeric digits, SEUR 14 or 21 digits or 2 letters plus 6 digits, MRW 12 alphanumeric) and rejects mismatches before dispatch, so an unlisted carrier is an operational dead end, not a preference.
Returns and the Spanish guarantee gap
Here is the single most expensive asymmetry in TikTok Shop Spain. TikTok's EU cancellation, returns and refunds policy dated 27 August 2026 contains explicit national overlays for exactly three markets, the Netherlands, France (defect remedy within 30 calendar days) and Poland (repair or replace first), and none for Spain. Spain therefore runs on the EU default: a 14-day statutory right of withdrawal, extended by TikTok to a 30-day change-of-mind benefit, with the product returned within 30 days of receipt.
Spanish law is more demanding than that default. Real Decreto-ley 7/2021 amended the TRLGDCU with effect from 1 January 2022, raising the minimum legal conformity guarantee from two years to three and mandatory spare-parts availability from five years to ten years after a product ceases to be manufactured. On TikTok Shop Spain the seller absorbs that third year alone, with no platform scaffolding behind it. Enforcement is shared between the national consumer ministry and the autonomous communities, so one Spanish store can be inspected by up to 17 regional consumer authorities.
Listing language on TikTok Shop Spain
Castilian Spanish is not a marketing choice in Spain, it is a legal one. Real Decreto 1468/1988 art. 8.1 requires that all mandatory labelling inscriptions on industrial consumer products sold in Spain "deberán figurar, al menos, en castellano, lengua española oficial del Estado". Separately, TikTok's EU returns policy requires that cancellation notices be in the customer's local language, and TikTok's Spanish Seller Academy itself serves only two locales, en-GB and es. Translating listings but shipping English-only packaging leaves you compliant on the page and non-compliant on the product.
Creator and affiliate mechanics in Spain
Spain has the hardest statutory influencer regime of any TikTok Shop EU market. Real Decreto 444/2024, in force from 2 May 2024 and implementing art. 94 of Ley 13/2022 General de Comunicación Audiovisual, makes a Spain-established creator a "usuario de especial relevancia" only where three thresholds are met cumulatively: gross prior-calendar-year platform income of EUR 300,000 or more, followers of 1,000,000 or more on a single service or 2,000,000 or more aggregated, and 24 or more videos published in the prior calendar year. Those creators must enter the Registro Estatal under Ley 13/2022 art. 39 and are treated as audiovisual media service providers for advertising identification, minor protection and the alcohol, tobacco and gambling promotion bans.
Below those thresholds, creator campaigns on TikTok Shop Spain are still policed by Ley 34/1988 General de Publicidad and Ley 3/1991 de Competencia Desleal, with self-regulation through AUTOCONTROL's influencer code. Practically: a brand running affiliate campaigns in Spain should know which of its creators cross the RD 444/2024 line, because their obligations become the campaign's compliance surface.
The Spain compliance stack, by named scheme
Packaging EPR. Ley 7/2022 and Real Decreto 1055/2022 require registration in the Registro de Productores de Producto (RPP), sección envases, held by MITECO, covering household, commercial and industrial packaging with no de minimis. Art. 15.2 requires a certificate of membership of a collective or individual system (SCRAP) at registration, and named collective SCRAPs include Ecoembes (light household packaging, and by its own statement commercial and industrial since 2024), Ecovidrio (glass) and Envalora (commercial and industrial). Art. 15.3 assigns a registration number that must appear on invoices and documentation accompanying commercial transactions.
Why POB exists in Spain. RD 1055/2022 art. 2.t) makes an e-commerce platform the "envasador" for packaging it places on the market for a third party's packaged goods, and makes the platform the "productor de producto" where packaged goods from outside Spain are sold through it and the producer has appointed no authorised representative in Spain. TikTok's answer is POB, and it is a listing gate: sellers are auto-enrolled if they have not submitted a valid EPR number, and TikTok states that sellers who decline POB without their own EPR registration number "will not be able to sell in-scope products on TikTok Shop France or Spain". TikTok also states that sellers are responsible for displaying the packaging EPR number on the invoice to Spanish consumers.
WEEE. Real Decreto 110/2015 art. 8.1 requires registration in the sección especial de productores de AEE of the Registro Integrado Industrial (RII-AEE) at MINCOTUR, which assigns a producer identification number. Art. 9 then imposes a distance-selling duty unique in its reach: the number must appear both on the page or instrument supporting the distance sale and on the invoice to the user, meaning the RII-AEE number has to be visible on the TikTok Shop Spain listing itself. A producer established in another Member State must appoint an authorised representative in Spain. TikTok offers no WEEE POB in Spain.
Batteries. TikTok names, for Spain specifically, the Registro de Pilas y Acumuladores (RII-PyA) as the government register and Sunrebattery as the PRO, with registration required at company level (unlike Germany, which additionally requires brand-level detail). Non-producer sellers must upload the upstream supplier's Spanish registration number plus the supplier's legal name and VAT ID.
Category bans. The EU Prohibited Products Policy applies to Spain with no local carve-out, and alcohol sits in the "no compatible" list, expressly including licores, vinos y cervezas. Also excluded: medicines and medical devices, e-cigarettes, vehicles and auto parts, live animals, infant formula and breast pumps, services, virtual goods, single-use plastics, chilled and frozen food, and second-hand or over-EUR-500 watches. Frequently asked questions
Can I sell wine, cava or beer on TikTok Shop Spain?
No. TikTok Shop's EU Prohibited Products Policy dated 6 August 2026 applies to Spain with no local exception and classes "alcohol y bebidas alcohólicas, incluidos licores, vinos y cervezas" as not compatible. Low-alcohol drinks, chocolate liqueurs and home brewing kits are also excluded from TikTok Shop Spain.
Do I need a Spanish company to sell on TikTok Shop Spain?
In the default case yes: TikTok Shop EU requires a Legal Entity applicant to be legally incorporated in the country of registration, hold inventory there and handle returns domestically, so TikTok Shop Spain expects a Spanish entity and a Spanish warehouse. No. TikTok Shop's WEEE Pay-on-Behalf service exists only in France, at 0.74%, so a seller of electrical goods on TikTok Shop Spain must register itself in the RII-AEE. Under RD 110/2015 art. 9 the producer identification number must be shown on the distance-sale page as well as on the invoice.
How long is the guarantee I must honour on TikTok Shop Spain?
Three years. Real Decreto-ley 7/2021 raised Spain's minimum legal conformity guarantee from two years to three with effect from 1 January 2022, and extended spare-parts availability to ten years after a product ceases to be manufactured. TikTok Shop's EU returns policy adds no Spanish overlay, so on TikTok Shop Spain the third year is entirely the seller's liability.
Can TikTok Shop Spain deliver to the Canary Islands, Ceuta and Melilla?
TikTok publishes no delivery-area exclusion list for Spain, so we cannot confirm whether those postcodes are served. What is certain is the tax position: Ley 37/1992 art. 3.Dos places Canarias, Ceuta and Melilla outside the Spanish IVA territory, so a shipment there from a peninsular warehouse is an export with IGIC or IPSI at destination, a split no other TikTok Shop EU market has internally.
What commission does TikTok Shop Spain charge a new seller?
The standard EU rate is 9% of GMV from 8 January 2026, with 7% for specified Electronics and Beauty and Personal Care device sub-categories. From 15 June 2026 a verified first-time EU seller who accepts the mission and lists at least 5 in-stock products within 15 days pays 4% on TikTok Shop Spain for 60 calendar days.
